Dataset description

This set of data contains the location of the delegates and an indication of the connection of the municipalities to a delegate of competence. Attention, this dataset is not exhaustive on the SALW perimeter, it concerns the perimeter of the former Aquitaine region. The Law of 13 August 2004 on local freedoms and responsibilities allows the State to delegate to the Public Establishments of Intercommunal Cooperation (EPCI) and to the General Councils that wish to manage stone aid. These communities are called delegates of jurisdiction. The delegation of competence includes the management of stone aids for social housing, aids for the improvement of private housing and rental-accession schemes. At the end of 2010, 28 general councils and 78 EPCI (61 agglomeration communities, 12 urban communities, 5 municipalities) are delegated powers. The aid they grant represents 50 % of the ANAH’s intervention budget. Within the framework of the delegation of competence, the authorities decide on the granting of aid for private housing, mainly to owner-occupiers, landlords and co-owners’ unions. They usually entrust the local delegations of Anah, located within the Departmental Directorates of the Territories (DDT), with administrative tasks related to the processing of aid applications. However, they can perform this function directly. As a delegation of competence, Anah plays a role in supporting and advising communities through the DDT. Where there is no delegation of competence, it is the local delegates of Anah in the region (region prefect) and in the department (prefect of department) who in liaison with the local authorities manage the aids for the private park. Without delegation of competence, the partnership between Anah and the local authorities is mainly formalised through the establishment of planned operations, in particular the Planned Habitat Improvement Operations (OPAH) and Public Interest Programmes (GIPs). The delegation of competence takes the form of a 6-year convention. The agreement is signed between the president of the EPCI or the general council and the prefect of the department, the local delegate of Anah in the department and representative of the State for the social park. It clarifies the distribution between appropriations for social housing and those allocated to private housing. For delegated EPCI, the delegation agreement is based on the detailed content of the Local Habitat Programme (PLH). The PLH is the tool for defining, programming and steering local housing policies. It is compulsory for EPCI and, outside EPCI, for municipalities with more than 20,000 inhabitants. For the delegated departments, the delegation agreement sets out the guidelines for the local housing policy to be carried out in the territory, sets out the operations to be planned and indicates the means to be used to implement them.
