Dataset Direct Download Service (WFS): Backward road areas (Article L111-1-4) on the department of Charente

Surface objects of the rearward zones of the highways on the department of Charente. Apart from the urbanised areas of the municipalities, constructions or installations are prohibited in a band of: 100 metres on either side of the axis of motorways, express roads and diversions within the meaning of the Highway Code; 75 metres on either side of the axis of other roads classified as high traffic. It shall not apply to: — constructions or installations linked to or necessary to road infrastructure; public services requiring the immediate proximity of road infrastructure; — farm buildings; — to networks of public interest. Nor does it apply to the adaptation, change of destination, renovation or extension of existing buildings. The local urban planning plan may lay down rules on location different from those provided for in this Article where it includes a study justifying that those rules are compatible with taking into account nuisances, safety, architectural quality, and the quality of urban planning and landscapes. In municipalities with a municipal map, the municipal council may, with the agreement of the prefect and after consulting the departmental commission responsible for nature, landscapes and sites, lay down rules for setting up different sites than those provided for in this article, in the light of a study which justifies, depending on local circumstances, that these rules are compatible with taking into account nuisances, safety, architectural quality, and the quality of urban planning and landscapes. The provisions of Article L111-1-4 of the Urban Planning Code may be derogated from, with the agreement of the Prefect, where geographical constraints do not allow the installation or construction to be installed beyond the margin of retreat provided for in the first subparagraph, provided that the interest of the municipality in the planned installation or construction justifies the derogation.
