Biotope Protection Order (BPA) The biotope protection order, better known as the simplified biotope by-law, is defined by a relatively simple procedure for the conservation of the habitat (under the ecological meaning) of protected species. A biotope protection order applies to the protection of habitats that are less exploited by humans and which are home to protected wild animal and/or plant species. It allows the Prefect to lay down by decree measures designed to promote, in all or part of the territory of a department, the conservation of the biotopes necessary for the feeding, reproduction, rest or survival of protected species. The objectives are the preservation of biotope (defined in the ecological sense of habitat) such as dunes, heaths, lawns, ponds,... necessary for the survival of protected species pursuant to Articles L. 211-1 and L. 211-2 of the Rural Code and, more generally, the prohibition of actions which may affect the biological balance of the environment. The effects of the classification: The Order sets out the measures which must enable the conservation of biotopes. The regulations apply to the environment itself and not to the species that live there (maintenance of plant cover, water level, prohibition of garbage deposits, constructions, extraction of materials, etc.).
