Dataset description

This dataset contains the boundaries of the municipalities affected by an effect band of a dangerous material transport pipeline in the New Aquitaine region. For municipalities in departments 24, 33, 40, 47 and 64: each municipality is accompanied by the rules for controlling urbanisation in the vicinity of a pipeline transporting dangerous goods (to bring to knowledge, DREAL information sheet) and, where appropriate, by its prefectural decree establishing the SUPs taking into account the control of risks around the pipelines. The effect distances are those caused by the so-called higher reference phenomenon (generated by a break or a 70 mm breach). A schematic representation of the positioning of the 3 effect bands can be found in the resource access box below. The distances displayed should be multiplied by 2 to have the total width of the corresponding effect band, i.e.: — to the IRE band = band of irreversible effects — to the band of PELs (or SEL) = band of the First Lethal Effects delimiting the area of serious dangers to human life — to the band of SLS = band of Lethal Effects Significant delimiting the area of very serious dangers to human life. Minimum planning rules are associated with each of the effect bands: — Inform the carrier of any application for a building permit or planning certificate granted in an area situated at a distance from the pipeline less than the distance indicated in the column entitled “IRE irreversible effects threshold” in the municipal record. — Consult the carrier as upstream as possible for any planned construction or extension of an establishment receiving the public (ERP) of more than 100 persons or of a high-rise building (IGH) in the area “IRE irreversible effects threshold” defined in the preceding paragraph. Indeed, the construction or extension of IGHs or ERPs falling from the 1st to the 3 rd category is prohibited in the “earlier lethal effects zone PEL” and in the “zone of significant lethal effects ELS”, this prohibition is extended to ERPs that can accommodate more than 100 people. Easements related to the consideration of risks: Pursuant to Article R 555-30b of the Environmental Code, SUP public easements are to be established in the areas of effects generated by dangerous phenomena likely to occur on the transport pipeline, in accordance with the distances set out in the prefectural decree of the municipality. These easements strictly govern the construction and extension of establishments receiving from the public (EPR) of more than 100 persons and high-rise buildings (IGH) in the following manner: • Servitude SUP1, corresponding to the lethal effect zone (PEL) of the dangerous reference phenomenon increasing within the meaning of Article R.555-39 of the Environmental Code (in general at the rupture of the pipeline): the issue of a building permit in respect of an ERP capable of receiving more than 100 persons or an IGH shall be subject to the provision of a compatibility analysis which has received the favourable opinion of the carrier or, in the event of an adverse opinion of the carrier, the favourable opinion of the Prefect given in the light of the expert opinion referred to in Article R 555-31 of Article R 555-31 of the Environmental Code. The compatibility analysis is drawn up in accordance with the provisions of the Ministerial Order of 5 March 2014 cited in reference. • Servitude SUP2, corresponding to the lethal effect zone (PEL) of the reduced hazardous reference phenomenon within the meaning of Article R.555-39 of the Environmental Code (brake 12 mm diameter): The opening of an LES that can accommodate more than 300 people or an IGH is prohibited in this bondage band. • Servitude SUP3, corresponding to the area of significant lethal effects (ELS) of the reduced hazardous reference phenomenon within the meaning of Article R.555-39 of the Environmental Code (brake 12 mm diameter): The opening of an LES that can accommodate more than 100 people or an IGH is prohibited in this bondage band. Furthermore, in accordance with Article R. 555-46 of the Environmental Code, the mayor shall inform the carrier of any building permit or urban planning certificate (information or operational) issued in one of the areas defined above. Construction and operating easements The easements linked to taking into account the risks referred to in paragraph above complement the construction and operating easements (also referred to as ‘strong and low-servitudes’) taken for pipes declared to be of public utility or of general interest (band of 4 to 10 metres wide depending on the diameters of the works). For the works concerned, the precise position of strong and weak easements is available from the carrier.
