Dataset description

The PPRSM of the Marais de Dol is established to prevent the major foreseeable risks of flooding by marine flooding in the territory of the Marais de Dol which comprises 22 municipalities. The PPRSM was approved on 25/08/2016. Law No. 95-101 of 2 February 1995 on strengthening nature protection established the Risk Prevention Plans (PPR) under Article 16-1 amending Articles 40-1 to 40-7 of Law No 87-565 of 22 July 1987 on the organisation of civil security, the protection of the forest against fire and the prevention of major hazards, now codified L 562-1 to L 562-7 of the Environmental Code. Title VI of the Environmental Code (Article L 562-1 et seq.), in its legislative part, supplemented by Title 6 of the regulatory part (Article R 561-1 et seq.) lays down the legal framework for the action of the State services with regard to the implementation of plans for the prevention of natural hazards. Article L 562-1 II of the Environmental Code provides that the purpose of risk prevention plans is to: demarcate risk-exposed areas, taking into account the nature and intensity of the risk involved, prohibiting any type of construction, construction, development or exploitation of agricultural, forestry, craft, commercial or industrial operations, in particular in order not to aggravate the risk to human lives, or, in the case where agricultural, forestry, forestry, craft, commercial or industrial construction, works, developments or holdings could be authorised, prescribe the conditions under which they must be carried out, used or exploited; identify areas that are not directly exposed to risk but where constructions, structures, developments or farms, agricultural, forestry, crafts, commercial or industrial operations could aggravate risks or create new ones and provide for prohibition measures or requirements such as those provided for in 1. define the preventive, protective and safeguard measures to be taken, in the areas referred to in 1. and 2., by public authorities within the scope of their powers, as well as those which may be incumbent on individuals; define, in the areas referred to in 1. and 2., the measures relating to the development, use or operation of buildings, works, areas grown or planted on the date of approval of the plan to be taken by owners, operators or users. The circular of 27 July 2011 on the “taking into account the risk of marine submersion in plans for the prevention of natural coastal hazards” specifies the procedures for taking into account marine hazard and protective structures in the plans for the prevention of coastal risks (PPRL). It also incorporates the impact of climate change to be taken into account in these plans. The circular of 2 August 2011 lists the municipalities to be the subject of a PPRSM and, as such, designates 22 municipalities in the Marais de Dol territory. The instruction was carried out within the framework set out in the methodological guide for the prevention of coastal risks (December 2013, updated in May 2014), carried out under the supervision of the Directorate-General for Risk Prevention (DGPR) of the Ministry of Ecological and Solidarity Transition (MTES).
