Dataset description

This layer of polygons lists the perimeters of Zones d’Aménagement Differéré (ZAD) on Rennes Métropole. The ZADs are tools of land action at the service of public policies. A Different Development Zone (DPA) is "a sector created by the State on the proposal of the local authorities within which a right of pre-emption allows a community to acquire property in the process of being disposed of as a priority. Since its creation in 1962, the ZAD tool was designed to prepare long-term development operations in order to prevent the announcement of a project from triggering an increase in land values. The right of pre-emption in ZAD must be exercised, like other pre-emption rights, “with a view to the realisation, in the general interest, of actions or operations corresponding to the objects defined in Article L.300-1, with the exception of those designed to safeguard or enhance natural areas, or to set up land reserves in order to enable the carrying out of such actions or development operations” (Art. L.210-1 CU). It is a pre-emption tool, in the same way as the Urban Preemption Right (DPU). All transfers of immovable property for consideration in the area may be subject to pre-emption, except for transactions excluded from the right of pre-emption by Article L.213-1 of the CU. The ZAD must serve the same purposes as the DPU. If the right of urban pre-emption and the right of pre-emption in the ZADs comply with common rules, laid down in Articles L.213-1, R.213-1 et seq. of the Urban Planning Code, they nevertheless constitute two alternative procedures. The attribute “observations” available in the database specifies the validity of the information. This layer contains archived data.
