Dataset description

Servitudes of public utility (SUP) are administrative limitations on the right to property. They are instituted for the benefit of public persons, service dealers or public works dealers, private persons engaged in a public interest activity. The collection and conservation of servitudes of public utility are a sovereign mission of the State which must bring them to the attention of the local authorities so that they annex them to their document d’' urbanism. The easements of public utility concerned are those defined by Articles L. 126-1 and R. 126-1 of the Code de l’' urban planning and their annexes. The T1-type SUPs concern the riparian properties of the railways and are established in areas defined by the law of 15 July 1845 on the police of the railways and by Article 6 of the decree of 30 October 1935 as amended on the creation of easements of visibility on public roads. Texts in force: * Law of 15 July 1845 on railway police — Title I: measures relating to the conservation of railways (Articles 1 to 11); * Road traffic code (created by Law No 89-413 and Decree No 89-631) and in particular the articles: —L. 123-6 and R.123-3 relating to the alignment on national roads, —L. 114-1 to L. 114-6 relating to visibility easements at grade crossings, —R. 131-1 et al. and R. 141-1 et seq. for the implementation of decommitment plans on departmental or municipal roads. Only visible easements at the crossing of a public road and a railway shall be subject to a procedure of #x27; specific introduction, i.e.: •before 1989, by prefectural order after the opinion of the municipal council or, where applicable, of the general council, •from 1989, by prefectural decree or by deliberation of the general council or municipal council, according to which it is #x27; it is a national road, of #x27; a departmental road or a municipal road. __Origin__ A T1 easement is of a surface type and corresponds to the right-of-way of the railway protection zone or its infrastructure. It is translated by a protection zone of 5 meters drawn all around the track or more according to plan annexed to the decree.
