Dataset description

The spatial planning procedure (ROV) is one of the classical instruments of regional planning. The legal bases are § 15 ROG and in Baden-Württemberg §§ 18 and 19 LPlG. The ROV provides a pre-explanatory opinion on the assessment of the spatial compatibility of spatially significant individual projects with a supra-local significance (e.g. route routing of a motorway, construction of large retail facilities, see § 1 of the Land Planning Ordinance). It clarifies whether a measure is compatible with the objectives and principles of the Spatial Planning Act and how spatially significant measures can be coordinated. The ROV has no direct external legal effect and cannot be challenged by administrative courts. However, it must be taken into account in the subsequent approval procedures. ROVs for surfaces are recorded as surface geometries. A recording of the point geometry takes place only if no sharp area delimitation is possible.
