Dataset description

The data set covers the spatial scope of the (as of 01/2021) 670 legally binding building plans (B plans) of the City of Wuppertal pursuant to §2 (1) Building Code (BauGB). The database also contains some implementation plans based on the North Rhine-Westphalia Construction Act, which were adopted before the entry into force of the Federal Building Act and still have the legal effect of a development plan today. The scope of the Wuppertal development plans is, in general, multipolygons, some of which are highly fragmented. For each of these polygons, the dataset contains some descriptive factual attributes such as the number and name of the B plan as well as a hyperlink to the corresponding digital plan document per plan part. An update of the database takes place only after a formal amendment or repeal of a B plan or after the adoption of a new B plan as statutes (a total of about 100 cases per year). The scope polygons are digitised on the basis of the digital plan documents (vectorial CAD project file and grid document of the B plan) based on the digital property map. The dataset is available under an open data license (CC BY-ND 4.0) with the exclusion of data modification. According to the AG Geokom.NRW of the leading municipal associations in North Rhine-Westphalia and the state of NRW, the legally binding development plans are subject to a statutory publication obligation in accordance with the requirements of the INSPIRE Directive and the Spatial Data Access Act NRW. The legally binding development plans are assigned in the recommendation for action of this WG to the topic of “soil use” in Annex III to the Directive.
