Flooding areas are important areas for flood and water protection, which are to be preserved in their function as natural retention areas; they are determined on the basis of a flood event, as is expected statistically once in 100 years. Measures and changes to the surface of the earth within legal flooding areas require approval in accordance with Section 78 of the Water Resources Act (WHG), § 113 Landeswassergesetz (LWG) by the competent authority. The district government, as the Upper Water Authority, is responsible for the determination of flood zones. This is done by regulatory ordinance pursuant to § 112 LWG with public participation (see § 76 WHG). The flood zones thus defined serve, among other things, as the basis for the planning of the construction management of the municipalities. In flooding areas, it can be related to this. Building restrictions and, if necessary, further restrictions on use so that the water drain is not hindered. Further details are laid down in the respective regulations.
