Dataset description

Building plans (binding building plans) are legally binding plans, which include construction stage plans, partial building plans, implementation plans and, since 1962, the current development plans according to the Federal Building Act (BBauG) or from 1986 according to the Building Code (BauGB). The development plans consist of the legislative or regulatory text with the textual determinations, a justification and (usually) the plan drawing. Development plans for smaller areas shall be subject to the binding provisions for the development and other use of the land. The data set covers the spatial scope of the (as of 2011) legally binding development plans (B plans) of the Kolpingstadt Kerpen pursuant to §2 (1) Building Code (BauGB). The database also contains some territorial scopes of the implementation plans, which are based on the North Rhine-Westphalia Construction Act, which was adopted before the entry into force of the Federal Building Act and continues to produce the legal effect of a development plan today. In general, the scope of the development plans of the Kolping town of Kerpen is multipolygons, some of which are highly fragmented. For each of these polygons, the record contains some descriptive attributes such as the number and name of the B plan. An update of the database takes place only after a formal amendment or repeal of a B plan or after the adoption of a new B plan as statutes. The scope polygons are for an overview only and were digitised on the basis of the digital plan documents (vectorial CAD project file and grid document of the B-Plan) based on digital geobasi data. The surrounding rings are neither sharp, nor do they have the claim to be overlap-free and seamless. In the first approach, they serve only the overview and access to the plan document. The dataset is available under an open data license (CC BY-ND 4.0) with the exclusion of data modification. The source notice is always required and in any manner of use and shall be designed according to the access and application limitation. According to the AG Geokom.NRW of the leading municipal associations in North Rhine-Westphalia and the state of NRW, the legally binding development plans are subject to a statutory publication obligation in accordance with the requirements of the INSPIRE Directive and the Spatial Data Access Act NRW. The legally binding development plans are assigned in the recommendation for action of this WG to the topic of “soil use” in Annex III to the Directive.
