Dataset description

The ATOM Feed Download Service for the legally binding conservation and design statutes Wuppertal provides a dataset for download, which covers the territorial scope of all the legally effective Wuppertal Articles of Association of the following 3 types: (1) Conservation statutes according to §172 Baugesetzbuch (Baugesetzbuch), (2) local building regulations adopted as articles of association in accordance with §86 Bauordnung NRW (BauO NRW) in the expressions “Ortsbildsatzung” and “Design statutes”, (3) combined conservation and design statutes according to §172 BauGB and §86 BauO NRW. The scopes were constructed on the geometric basis of the digital property map based on the contents of the articles of association (planned installations and textual location descriptions). When a statute makes statements about the design of building facades, the spatial scope was designed in such a way that the facades concerned are within that scope. The database is complete and as of 01.05.2017 it included 11 articles of association with a total of 16 areas. Each of these areas has, among other things, a property attribute containing a hyperlink to the corresponding PDF Statute document, e.g. in the form of a copy of the articles of association with scanned original plan plants. A continuation of the database takes place only if a new conservation and/or design statute has become final or after a legally effective amendment of an existing statutes. However, the data that the download service accesses will be updated on a regular basis for security purposes. The data set provided by the download service is subject to an open data license excluding data change (CC BY-ND 4.0). According to the AG Geokom.NRW of the leading municipal associations in NRW and the state of NRW, the conservation statutes pursuant to §172 of the BauGB and the local building regulations adopted as statutes pursuant to §86 BauO NRW are subject to a statutory publication obligation in accordance with the requirements of the INSPIRE Directive and the Geodata Access Act NRW. Both types of articles of association are assigned to the topic of “soil use” in Annex III to the Directive in the recommendation for action of this AG.
