Dataset description

The data set “Landscape Conservation Areas Wuppertal” covers, on the one hand, the scope of the landscape protected areas established pursuant to §7 of the Landesnaturschutzgesetz NRW (Landscape Conservation Act NRW) in the four legally binding landscape plans of the City of Wuppertal (Wuppertal-GELPE, Wuppertal-Ost, Wuppertal-Nord and Wuppertal-West) and, on the other hand, residual areas from landscape protected areas previously defined by the Land NRW in the “Ordinance for the Protection of Landscape Areas in the City of Wuppertal” of 30.01.1975 and the “Ordinance for the Protection of Landscape Areas in the City of Düsseldorf and the District of Düsseldorf-Mettmann” of 2 June 1971 (Landscape Protection Regulations). The latter regulation applied to the districts of Schöller and Dönberg, which were incorporated into the city of Wuppertal on 1 January 1975. (With the establishment of the protected areas in the landscape plans, the vast majority of the protected areas were abolished by regulations of the Land. However, there are still numerous remaining areas, which still have the status of a landscape protection area under a Landscape Protection Regulation, e.g. some parks in the inner-city areas.) The spatial scopes of the landscape protected areas were constructed by the department of surveying, cadastral office and geodata by expertly interpreting the analogue and digital originals along parcel boundaries, boundaries of actual use or other topographical lines of the land register. In doing so, the files relating to case-by-case planning information given earlier on the location of a parcel within or outside a landscape protected area were also used in order to avoid contradictory statements by the city administration in this regard. Rare, case-by-case continuations of the data stock (average approximately once a year) are carried out on the basis of development planning procedures and associated changes to the land use plan. An extensive continuation of the data will only take place if a new landscape plan has become final or after a legally effective amendment of an existing landscape plan. The dataset is available under an open data license (CC BY-ND 4.0) excluding the data change. According to the AG Geokom.NRW of the leading municipal associations in North Rhine-Westphalia and the state of NRW, there is a legal obligation to publish the landscape protected areas in accordance with the provisions of the INSPIRE Directive or the Geodata Access Act NRW. In the recommendation for action of this WG, they are assigned to the subject of “protected areas” in Annex I of the Directive.
