Dataset description

The following provisions are added to Section 2 of the Bergedorf Development Plan 35 Act of 2 October 1975 (Hamburgian Law and Ordinance Gazette, page 176): 4. In the core areas north of Bergedorfer Straße, with the exception of parcel 4009, gambling halls and similar undertakings within the meaning of Paragraph 33 i of the Trade Code, which serve the installation of play equipment with or without profit, as well as sales rooms and sales areas, pre-emption and commercial premises whose purpose is aimed at the sale of articles, representations or acts of sexual character, shall be prohibited. 5. Core areas in which the Ordinance on the Protection of the Milieu Area Sachsentor of 13 June 1978 (Hamburg Law and Ordinance Gazette, page 202) applies, are defined as the “maintenance area” according to § 172 of the Building Code. In this area, in order to preserve the urban characteristics of the area on the basis of its urban design, the demolition, modification, change of use or the construction of construction facilities require authorisation, even if a permit is not required under the Building Exemption Ordinance of 5 January 1988 (Hamburg Legislative and Ordinance Gazette, page 1). The approval for demolition, modification or change of use may only be refused if the construction plant, alone or in connection with other structural installations, characterises the townscape or the urban design or is otherwise of urban planning, in particular historical importance. The permit for the construction of the construction installation may be refused only if the urban design of the area is affected by the requested construction facility.’
