The law enforcement statistics are a secondary survey based on the administrative data of the enforcement authorities (professional offices and juvenile courts). Administrative offences, even if they fall within the jurisdiction of the criminal courts, are not taken into account. In the case of the conviction of offences committed in a unit or majority, only the offence which is threatened by the law with the most severe penalty is statistically recorded. If several offences of the same person are convicted in several proceedings, the accused shall be counted separately for each criminal proceedings. According to § 10 StGB, the general criminal law applies to acts of adolescents and, where applicable, adolescents only, unless otherwise specified in the Juvenile Court Act (JGG). The judge must make the decision whether an adolescent must be judged according to the StGB or JGG after appraisal of the perpetrator’s personality and the nature of the offence.
