Servitude and Restriction of Public Utility (SRUP) — Telecommunications, in force in mainland Portugal. The constitution of servitudes and restrictions of public utility related to Telecommunications (radioelectric servers) follows the regime provided for in the law, being inserted within the scope of Infrastructure. Radio servitudes shall be constituted, modified or extinguished on a case-by-case basis by ministerial order. A radio station shall be deemed to be a set of stationary radio installations for emission or reception, including irradiant and ground systems and their supports which require the use of directional antennas or intended for radio navigation service, belonging to the State or public telecommunications undertakings or concessionaires of the public radio communication service. Areas subject to radio servitude include release zones and clearing areas. Release zones are the bands surrounding radio centres designed to protect them both from obstacles that may impair the spread of radio waves and from electromagnetic disturbances affecting the reception of such waves. The clearing zones are the bands with the axis of the line joining, in horizontal projection, the antennas of two radio centres ensuring links by hertzian beams in direct visibility or transorizont connections, in which servitude is intended to ensure free spread between the two centres. The width of the clearance zone measured perpendicular to the straight line joining the two centres shall not exceed 50 m on either side of that line and may in special cases be increased on certain sections to encompass the horizontal projection of the ellipsoid of the 1st Fresnel zone. The constitution, modification or extinction of radioelectric services is the responsibility of the Ministers who protect the areas related to communications.
